Employment Law Provisions of the Genetic Information Nondiscrimination Act of 2008 (GINA)

Abstract

Mark Rothstein will present this timely webcast about the employment law provisions of GINA. GINA is the Genetic Information Nondiscrimination Act, Title II of which deals with employment discrimination on the basis of genetic information. Professor Rothstein’s presentation will include:

  • the history of, and reasons for enacting, GINA,
  • the definition of genetic information,
  •  the definition of a genetic test, the key provisions of GINA,
  • methods of acquiring genetic information that are not unlawful,
  • permissible disclosures of genetic information,
  • permissible genetic monitoring in the workplace,
  •  GINA’s limitations,
  • how GINA’s employment provisions create a gap with the ADA’s protections, and
  • genetic predisposition and the ADA.
