Each State is required to maintain a Statewide Independent Living Council The Council cannot be established as an entity within a State agency, but the free-standing group may or may not be established as a 501(c)3 corporation..

Members of the Council shall be appointed by the Governor. The Governor shall select members after soliciting recommendations from representatives of organizations representing a broad range of individuals with disabilities and organizations interested in individuals with disabilities, within some specific requirements in Title VII of the Rehabilitation Act, section 705.

The Council jointly develops and signs (in conjunction with the designated State unit) the State Plan for Independent Living, then monitors, reviews, and evaluates the implementation of the State plan;
